Abramovich beats "dishonest" Berezovsky in court

LONDON (Reuters) - Chelsea Football Club owner Roman Abramovich emerged victorious on Friday from a $6 billion legal battle with his former mentor Boris Berezovsky that has laid bare the intrigue behind the post-Soviet carve-up of Russia's vast natural resources.

Berezovsky, who became a Moscow powerbroker under the late President Boris Yeltsin only to fall foul of Vladimir Putin, had accused Abramovich of using the threat of Kremlin retribution to intimidate him into selling prized assets at a knockdown price.

But Judge Elizabeth Gloster told a packed London courtroom that she had found Berezovsky to be an "unimpressive and inherently unreliable witness" who gave sometimes dishonest evidence and would say "almost anything to support his case".

Gloster dismissed all of Berezovsky's $6 billion in claims in one of the biggest private litigation cases ever, saying Abramovich - the world's 68th richest man with a $12.1 billion fortune - was a "truthful and on the whole reliable witness".

"I am absolutely amazed about what happened today," Berezovsky, 66, told reporters after listening expressionless as the verdict was read out in a modern, glass courtroom crowded with lawyers, bodyguards and journalists.

"My confidence in English justice has been undermined by the judge's decision," he said, adding that the ruling was so sympathetic to Putin that it read as if the Kremlin chief had written it himself.

But such a stinging rebuke from one of Britain's most experienced commercial judges is likely to cement Berezovsky's reputation as a publicity-seeker and opens him up to claims for costs that could exceed $100 million.

"There was a marked contrast between the manner in which Mr Berezovsky gave his evidence and that in which Mr Abramovich did so," Gloster said in an hour-long dissection of Berezovsky's claim which delved into the murky world of Russian business.

Abramovich, who made headlines by buying Chelsea in 2003, had denied Berezovsky owned the assets and said that he merely paid Berezovsky for political cover and protection - known in Russian gangster slang as "krysha" or "roof".

RUSSIAN "KRYSHA"

The 38-page preliminary ruling marks the beginning of the end for a legal odyssey stretching from the gilded corridors of the Kremlin via the offshore enclaves favored by Russia's tycoons to the rarefied atmosphere of London's High Court.

Judge Gloster stumbled at times trying to pronounce "krysha", a term used by leather-jacketed gangsters on the streets of Russian cities and now the partial basis of a ruling in one of the most respected legal systems in the world.

"It is a very tough verdict for Mr Berezovsky: it is very much based on an appreciation of him as a witness whether that is justified or not and he clearly thinks it is not," said Philippa Charles, a litigation partner at law firm Mayer Brown, which is not directly involved in the case.

The case has captivated some of the top lawyers in Britain, whose globally respected, tradition-bound courts where barristers still wear wigs have become the venue of choice for the international rich to sue each other. Russian firms often settle their legal differences in London because they do not trust the courts at home.

Friday's judgment comes less than a month before the main proceedings in another legal battle between two Russian tycoons ? metals billionaire Oleg Deripaska and his former associate Michael Cherney ? are set to begin in a London courtroom.

Berezovsky had claimed that Abramovich used the threat of retribution at the hands of Putin's Kremlin to intimidate him into selling out of Sibneft, Russia's fourth biggest oil company, at a knockdown price.

The judge said that though she felt the court had not got the full picture of the relations between Berezovsky, his late partner Badri Patarkatsishvili, and Abramovich, she had dismissed the $5 billion Sibneft claim and another $565 million claim relating to claimed ownership in aluminum company RUSAL.

Abramovich was not in court to hear the verdict and his team of lawyers, led by Karyl Nairn a litigation partner at Skadden, Arps, Slate, Meagher & Flom LLP, merely smiled as the judge read out her lengthy statement.

"There were many serious allegations made against Mr Abramovich by Mr Berezovsky, including attacks on Mr Abramovich's honesty and integrity," Abramovich's investment vehicle, Millhouse, said in a statement.

"We are pleased that the Judge has firmly rejected all such allegations and has described Mr Abramovich as a truthful and frank witness who showed a responsible and honest approach when giving evidence in this case."

RUSSIAN BUSINESS

The titanic legal battle had provided rich pickings for the media ever since a tussle broke out between the two tycoons and their retinues of bodyguards in a Hermes luxury boutique in London in 2007, when Berezovsky served Abramovich with a writ.

That gave an early glimpse of what was to come, with the hearings revealing the extravagant lifestyles of Russia's super-rich: helicopter flights to luxury ski resorts in the Alps, Caribbean cruises, English country estates and French chateaux.

But besides the drama and vast legal costs of a battle between two of Russia's most prominent businessmen, the case has detailed the treacherous business world of post-Soviet Russia:

Ownership rights so flimsy even powerful tycoons like Abramovich needed krysha stretching up to the Kremlin itself, offshore cash as king and the constant insecurity of a system where assets could be expropriated at will.

Complete with blatant tax evasion, vague deals on billion-dollar assets and a fly-on-the-wall view from inside the adrenaline bubble of Russia's A-team of oligarchs, the case reveals the country's heady corruption.

Even the evidence read like a John le Carre thriller: barristers bickered over handwritten notes from an offshore lawyer who died in a mysterious helicopter crash, a snatched conversation on tax avoidance recorded in secret at Le Bourget airport, and a meeting at London's Dorchester Hotel to hash out the creation of the world's biggest aluminum company.

At Putin's Novo-Ogaryovo residence outside Moscow, his spokesman suggested Berezovsky had slandered Russia during the hearings.

"It is always a pleasure when slander is called by its true name," Putin spokesman Dmitry Peskov told reporters when asked about the case.

Russian state television reports cast the legal battle as evidence of the dire state the country was in following the 1991 collapse of the Soviet Union, a period Putin has described as a tragic and chaotic era when the country was on its knees.

"We've heard a great deal here in the last few months as the lawyers dragged once-confidential information out of the former friends, now opponents, about ways to make billions in a half-destitute country," said the report on Rossiya-1 television.

Berezovsky said he was considering whether to appeal.

New life for decades-old Wis. cheddar blocks

MILWAUKEE (AP) ? A recently discovered block of eastern Wisconsin cheddar cheese that dates back to the Nixon presidency will be sold for $10 per ounce.

Edward Zahn, 73, was in Z's Cheese Shoppe's walk-in cooler last month, preparing to shut down his Oconto store. He pushed aside stacks of cheese to reveal several wooden boxes that had been overlooked for years.

Inside were blocks of unintentionally aged cheddar ? 28, 34 and 40 years old ? that, some experts say, might comprise the oldest collection of cheese ever assembled and sold to the public.

"It just got overlooked," Zahn told the Wisconsin State Journal of the 40-year-old cheese. "It looks just like the others except it's just a lot sharper. It's got character."

Ken McNulty, who owns the Wisconsin Cheese Mart in Milwaukee, bought about 20 pounds of the 40-year-old cheddar and 120 pounds of 34-year cheddar. He declined to reveal the price he paid.

Cheese is often sold by the pound, but McNulty plans to sell the oldest cheese by the ounce so more people can get a taste.

"Because there's so little, we didn't want to sell blocks of it on the Web," he told The Associated Press. "We just wanted people to sample it."

He said an ounce would be just enough for two people to nibble on. He suggests sampling the vintage cheese by itself, not with a cracker or other food that would compete with the flavor.

He said he found out about the cheese when Zahn's son called, told him his father was closing up shop and offered to sell some inventory. McNulty, long a fan of Zahn's cheesemaking expertise, said he wanted everything.

McNulty sampled the 40-year-old and 28-year-old blocks, pleasantly surprised that the milk in the cheese hadn't soured. He still hasn't tried the 34-year-old cheese, and acknowledges that he can't assume it will be edible. He plans to cut it open on Oct. 6 as part of a cheese-tasting event at his store.

Wisconsin, the nation's leading cheese producer, last made headlines for aged cheese in 2010 when Tony Hook, the co-owner of Hook's Cheese Co. in Mineral Point, sold 1,600 pounds of 15-year-old cheese for $50 per pound. Cheese connoisseurs described that cheddar as mature, rich, smooth and decadent.

So what does cheddar taste like when it's been sitting around since 1972, the year "The Godfather" was released and when gas was 55 cents per gallon?

"If you get a piece close to the outside, it's all crystallization, so it's crunchy like Corn Flakes," McNulty said. "As you get closer to the interior, it's creamier and overwhelmingly sharp."

The morning after Paul Ryan?s debutante ball at the Republican National Convention in Tampa, the Internet had one thing to say: Condoleezza Rice.

Condi was better, said the Atlantic.

How this story got collaboratively and instantaneously written?that Condoleezza Rice, former Secretary of State, stole the show from Paul Ryan, Mitt Romney?s running mate, on Wednesday night?was as mysterious as the Internet itself. At play may have been Carl Jung?s idea of the collective unconscious, or James Surowicki?s more recent theory of the wisdom of crowds.

From where I sat, in the cavernous Tampa Times Convention Hall, amid a pack of sleepless reporters, the idea seemed palpably to dawn. First sounded the unmistakable and rousing chords of ?Sweet Home Alabama??a reference to Rice?s home state, and one of the few genuinely stirring songs on the RNC playlist. Ears pricked up. Heads bobbed.

Rice appeared, in pearls and rose-colored satin, against a deep blue backdrop. (The backdrop has shifted hues throughout the convention.) Compact, with shoulders squared, Rice seemed like one of those indomitable creatures whose vigilance never flags, who might review documents in seven languages on a flight to Saudi Arabia, deeply meditate on her unshakable faith and then run a half-marathon upon landing in Jeddah. In an abaya.

Indeed, on the dais last night, Rice assumed a characteristic challenge. She spoke without a TelePrompTer?the first speaker of the convention to eschew that toxic prop. The result was not, interestingly, that Rice faced the audience more, with more authenticity. In fact, she faced us less, glancing down periodically at what seemed to be her paper notes on the podium. Surprisingly, the breaks in eye contact?the looking down?seemed modest, professorial, human. They paced the speech properly. They prevented the hollow middle-distance stare of TelePrompTer addicts.

It was as though an oversharp, hyperpixelated, high-def image?the kind it hurts to look at?suddenly took on the mellow, old-fashioned hues of a Sargeant painting, or a Hopper, or an HBO movie. The convention became watchable again. Its characters became real.

Deepening this effect?sealing it?was Rice?s voice. She didn?t have the steroidal forced baritone of politicians who gargle all day, and take prednisone, to ensure vigor in their voices. Instead, Rice?s delivery a tremolo charm. Her voice quavered with emotion.?

Nods all around. As Rice tightened the rhetorical connection between integrity at home and authority abroad?calling the world ?a chaotic and dangerous place? whenever America dithers and equivocates, as she believes it now does?she bracingly made her point. ?Our foes can have no reason to doubt our resolve,? she said. ?Because peace really does come through strength.?

And lest the audience think that ?resolve? is merely an abstraction to Rice, she briskly reviewed some autobiography. ?And on a personal note,? she said. ?A little girl grows up in Jim Crow Birmingham?the most segregated big city in America. Her parents can?t take her to a movie theater or a restaurant, but they make her believe that even though she can?t have a hamburger at the Woolworth?s lunch counter, she can be President of the United States. And she becomes the Secretary of State.?

My colleague Walter Shapiro?who has covered more conventions, more astutely, than anyone at the online upstart publications whose reporters in Tampa were mostly throwing photos up to Instagram?said he thought it was the first genuinely moving moment in the convention.

It was impossible to disagree.

    For over a decade, Congress has debated the DREAM Act. The bill would grant permanent residency to illegal immigrants who grew up in the United States and who argue they belong more to this country than the one they were born in. Needless to say, the bill is a political football, especially in this election year. Candidates alternatively portray illegal immigration as one of America?s best traditions and the last straw for a weak economy.

    While politicians and the public make up their minds, a generation waits. Policy nuances aside, at the heart of the bill is a question of whether we, the United States, want to claim these children as our own, nurture them, and ultimately trust them to take care of us. The question is deeply familiar to Reyna Grande, a 30-something author who has hovered her entire life between Mexico and the United States, between her mother and her father. She tells her achingly sad story of waiting to be wanted in her memoir and third book The Distance Between Us.

    Grande?s father illegally crossed into the United States in the late 1970s, leaving his wife and three young children in Mexico. Like many, he went to ?El Otro Lado? ? the Other Side ? to make money and eventually return to his hometown with enough cash to build a house and steer his family out of poverty.

    A year later, Grande?s mother left for El Otro Lado, too. Her husband had summoned her, she told the neighbors proudly, because he needed her help. She left the children with their paternal grandmother, promising she would return in a year.

    But Grande?s mother never returned ? at least not as the same person who tenderly told her children goodbye. The first half of Grande?s memoir, called ?Mi Mam? Me Ama? or ?My Mother Loves Me,? chronicles her and her siblings? longing for their mother and the abuses they suffer at the hands of relatives and friends for being orphaned.

    Eventually it?s Grande?s father, a person the narrator knows only from a framed photograph, who plucks the children from their misery and smuggles them across the border. But life in the Other Side, as Grande describes in the book?s second half, ?The Man behind the Glass,? is no paradise, either. Grande?s father lives with a woman who?s not thrilled to have three lice-infested, malnourished, Spanish-speaking kids sleeping on her floor and eating her groceries. And Grande?s father himself is barely surviving as a manual laborer for a Los Angeles nursing home. Except for the occasional inspirational speech about the importance of education, his childrearing relies heavily on beatings and beer.

    Grande effectively keeps the perspective at a child?s eye level. She and her brother and sister aren?t perfect, but they?re heroes. The story rises with hope every time the kids seem to find an ally, only to crash when their would-be protector is unable or unwilling to come through.

    To Grande?s immense credit, she also manages to convey the adults? point of view sympathetically. Miraculously, she even finds reason for gratitude. For instance, although her father withheld nearly all emotional and material sustenance, she notes that at least his refusal to buy junk food kept the children from becoming obese.

    These tiny artifacts of value, which Grande dredges from her childhood like aluminum cans out of a trash heap, help create a visceral experience of poverty. As Grande ably shows, poverty is not only the child who cannot have what she desperately needs and wants ? a meal, a bed, a filled cavity, a quincea?era, love. Poverty is also the adult who has too little to give. The Grande family story is no less heartbreaking for the want of the parents, who are as ashamed for failing their children as their progeny are disappointed.

    Although "The Distance Between Us" doesn?t have the literary virtuoso of, say, "Angela?s Ashes," it accomplishes one of the great things books can do: make an abstract idea real.     IBM buying Kenexa for approximately $1.26 billion

    ARMONK, N.Y. (AP) ? IBM is buying human resources software company Kenexa Corp. for about $1.26 billion, adding to its stable of cloud-based software.

    The Monday announcement sent Kenexa's stock to the highest point since it began trading in mid-2005.

    Kenexa's HR software is designed to help companies recruit workers and manage employees. The Wayne, Pa., company says it has more than 8,900 customers. IBM said that it plans to continue to support Kenexa's clients while also giving them access to IBM's offerings.

    The acquisition helps make the Armonk, N.Y., company more competitive with database maker Oracle Corp. and German business software maker SAP AG, said Rick Sherlund of Nomura Equity Research. Oracle and SAP have both recently been buying "cloud computing" companies. Such technology allows businesses to run software remotely rather than installing software in-house.

    IBM Corp. said that it will pay $46 per Kenexa share, a 42 percent premium to the company's Friday closing price of $32.39. Kenexa has about 27.4 million outstanding shares, according to FactSet.

    Kenexa stock jumped $13.45, or 41.5 percent, to $45.83 in midday trading Monday. Earlier in the session the stock reached $45.93, its highest point since the employee management software maker started trading in June 2005. Shares had gained 21 percent this year.

    IBM stock slipped $1.15 to $196.62.

    Kenexa's board unanimously approved the deal, which is expected to close in the fourth quarter. It still needs approval from the company's shareholders and regulators.

    Oldest Diver In Limerick Still Enjoys Scuba Diving Adventures ...

    A scuba diver has become the oldest diver in Limerick and possibly Ireland, and despite celebrating his 80th birthday recently, he has no immediate plans to give up the underwater sport.

    Ronnie Hurley, one of the founder members of Limerick Sub Aqua Club, has been going on scuba diving holidays to destinations all over the world for the past 52 years.

    ?Ronnie is a real Limerick hero. He is a fantastic, inspiring figure. He is without a doubt admired throughout the whole club and further afield,? commented Mike Orth, the chairman of the Limerick Sub Aqua Club, which was established in 1960.

    Ronnie explained his passion for scuba diving adventures and said: ?When I started diving in my 20?s I wanted to boast that I?d dive into my 80s. Now, I only dive in good conditions, when the water is warm and there?s plenty of fish life. Back then I?d dive every weekend, and would curse the weather if it wasn?t right. Now I think the odd time ?Wouldn?t it be lovely to be diving today?.?

    Because of his age, Ronnie cannot dive as deep or for long periods of time, but this hasn?t stopped the pensioner from enjoying the underwater sport.

    ?I need help putting on my gear and my fins. I?m a bit stiff. I?m not an invalid but I have to be helped. Age is relative. I don?t look at myself as an 80-year-old diver, but I?m lucky people put up with me,? he commented.

    Ronnie took the first of his many scuba diving holidays in 1960 in the Spanish Point and over the past five decades he has enjoyed trips to scuba diving destinations such as the Caribbean, Florida, Spain and Great Britain.

    Scuba diving in the Red Sea is his all-time favourite but his most memorable dive was in Florida when he and four others dived off the USS Spiegel Grove, a 155-metre-long vessel that was sunk deliberately in Key Largo.

    ?It was an amazing dive, just awesome,? Ronnie said.

    The 80-year-old diver keeps fit by cycling around town and going to the gym three times a week and it helps that he never drank alcohol excessively or smoked.

    ?I?m blessed with a reasonable body, that?s why I try to do this. People say ?Aren?t you great to do this??, but I?m not. It?s just what I enjoy,? he added.

    After celebrating his 80th birthday recently, Ronnie Hurley has become the oldest scuba diver in Limerick and possibly Ireland. As one of the founders of the Limerick Sub Aqua Club, he has been enjoying scuba diving holidays in destinations all over the world (including exotic locations like the Caribbean) for 52 years and he has no intention of stopping the adventures just yet.

    Wall Street Week Ahead: S&P to fly after wild ride to Wyoming

    NEW YORK (Reuters) - The streak is over, but is the trend intact?

    A six-week string of gains in the S&P 500 <.spx> ended on Friday amid shifting expectations for central bank stimulus. This week could bring clarity on that issue, and that could determine whether the recent rally that took the index to four-year highs will persist.

    "The streak is broken, but the trend isn't, and I think the next major move on the S&P will push us up towards 1,450 or 1,500," said Mark Arbeter, chief technical strategist for Standard & Poor's in New York. "Small- and mid-cap stocks are near their all-time highs, and if they break those highs, I think that will prompt the market to really rip higher."

    Still, the market could be in for a bumpy ride this week ahead of Friday's meeting of central bankers in Jackson Hole, Wyoming. Investors are looking for clues on whether Federal Reserve Chairman Ben Bernanke will announce a third round of quantitative easing.

    Bets on aggressive action to increase growth have spurred most of the market's recent gains, meaning any disappointment could stop the rally in its tracks. The CBOE Volatility index or VIX <.vix>, a measure of investor anxiety, jumped almost 13 percent last week.

    While many analysts expect QE3 - and Bernanke wrote a letter to a congressional panel that the Fed has room to deliver it - the odds seemed to decline following comments on Thursday from James Bullard, a non-voting member of the Federal Open Market Committee. He said the latest Fed minutes, which indicated the central bank might be ready for more stimulus, were "stale.

    "Rhetoric is going back and forth about what we can expect, and we could see some big gyrations going into the meeting, depending on the latest rumor," said Michael Matousek, a senior trader at U.S. Global Investors Inc in San Antonio.

    IS QE3 BAKED INTO THE CAKE?

    In the recent six-week winning streak, the S&P's longest since January 2011, the index climbed 4.7 percent. That could indicate QE3 has already been priced into shares.

    "I think we're priced so that we won't see a major move if something is announced," Matousek said. "But if the status quo persists, which is what I'm expecting, that could be a big disappointment."

    Daily trading volume, which has been among the lowest of the year recently, is expected to remain muted ahead of the meeting. Low volume could amplify stock swings in both directions, and there is little other news to otherwise drive trading.

    Following the Jackson Hole meeting, there will be a market holiday on September 3 for Labor Day. Trading is expected to pick up after that, with a major catalyst seen on September 6, when the European Central Bank has its next meeting.

    The ECB recently pledged to "do whatever it takes" to address the euro zone's debt crisis, comments that contributed to recent positive sentiment.

    Earnings season is winding down, with only five S&P 500 components scheduled to report in the coming week, including Tiffany & Co , Joy Global Inc and H.J. Heinz .

    With 98 percent of S&P 500 companies having reported results, 67 percent have topped expectations by an average surprise factor of 4.3 percent, according to Thomson Reuters data. The 67 percent beat rate is higher than the long-term average of 62 percent. However, there have been some notable disappointments lately, including Hewlett-Packard Co .

    Economic indicators includes August reads on consumer confidence and sentiment, the latest read on Chicago PMI and July pending home sales. The Fed's Beige Book, a collection of anecdotal information on current economic conditions, will also be released.

    "The market is torn between macroeconomic concerns on one hand, and relatively good earnings and business trends on the other," said John Carey, who helps oversee $260 billion as a portfolio manager at Pioneer Investment Management in Boston.

    "I'm encouraged by the fundamentals out there, but unquestionably, the economy has slowed."

    The S&P 500 fell 0.5 percent last week, a relatively mild decline after six weeks of gains. On Tuesday, it surged to its highest level since June 2008 before pulling back. The Dow Jones industrial average <.dji> slid 0.9 percent for the week, while the Nasdaq <.ixic> slipped 0.2 percent.

    For the year, all three major U.S. stock indexes have racked up substantial gains. The Dow has gained 7.70 percent for 2012 so far, while the S&P 500 had advanced 12.21 percent and the Nasdaq has climbed 17.84 percent.

    "The market has been so strong lately that there's the idea Bernanke could pull back from QE3 as a result of that," said Randy Frederick, managing director of active trading at Charles Schwab in Austin, Texas. "But then, all that really means is that the market is able to stand on its own two feet."

    Vietnam political battles heat up as economy falters

    The arrest of one of Vietnam's top banking tycoons reflects a wider power struggle among the Communist rulers over how to tackle the country's deepening economic troubles, experts say.

    Flamboyant multi-millionaire Nguyen Duc Kien, a shareholder in some of Vietnam's largest financial institutions and a founder of Asia Commercial Bank (ACB), was detained on Monday, and ACB's ex-head officially joined him in custody three days later.

    The arrests, for unspecified economic crimes, caused public panic, wiping some $5.0 billion in value from Vietnam's stock markets and triggering a bank run as depositors rushed to pull hundreds of millions of dollars out of ACB.

    But "the bigger concern is the potential for political instability... Kien's arrest could signify increasing discord among political elites and factions", according to a report by intelligence group Stratfor.

    Football-mad Kien, an instantly recognisable 48-year-old financier with a shock of white hair, is widely reported to have close connections to Prime Minister Nguyen Tan Dung and his daughter, a Swiss-trained private banker.

    Since the 1990s, as Vietnam opened up economically, power moved from the communist party to the state -- and, since he assumed the post in 2006, to Dung, who is said to be the country's most powerful prime minister ever.

    Dung, who was reelected to a second five year term in 2011, has used this power to aggressively push for high growth rates and champion a South Korean chaebol-style development path, relying on huge state-owned companies to drive overall economic growth.

    At first, Vietnam was notching up seven percent-plus annual growth rates and quickly became a favourite of foreign investors including global banking giant Standard Chartered, which owns 15 percent of ACB.

    But with economic growth now just 4.4 percent year-on-year in the first half of 2012, foreign direct investment down nearly 30 percent in the same period and toxic debt in the fragile banking system at "alarming levels" according to the central bank, there has been increasingly vocal criticism of Dung.

    "Never has Vietnamese society faced so many unheavals which weaken the Party's leadership and threaten the survival of the whole political regime," a retired National Assembly deputy told AFP.

    "Some party leaders have lost patience, and feel it is time to act to eliminate these potential threats and regain public confidence," he added, speaking on condition of anonymity.

    In a scathing op-ed on Thursday, President Truong Tan Sang -- one of Dung's main political rivals -- said that "Vietnam is now under not insignificant pressure because of broken state-owned enterprises."

    He criticised "the degradation of political ideology and the morals and lifestyle" of officials -- a swipe at wealthy tycoons like Rolls Royce-driving Kien -- and called for economic reform and a new anti-corruption drive.

    A new round of factional fighting has begun and "the main battleground is economic reform and probity including the state-owned sector and the banking sector and weeding out entrenched large-scale corruption", said Vietnam expert Carl Thayer.

    "Sang and Party Secretary General Nguyen Phu Trong are now repeating an old but true refrain that corruption is one of the major threats to the legitimacy of Vietnam's one-party system," Thayer said.

    Public discontent over official corruption has bubbled over into violent protests several times this year.

    The case of a farmer who used home-made explosives to fight forced eviction by corrupt local officials dominated the front pages in January.

    Thayer pointed to the significance of a decision earlier this month to remove control of the anti-corruption steering committee from the prime minister and hand it back to the party.

    Dung has previously come under pressure for corruption scandals in the state-owned companies he promoted, and in 2010 was forced to accept personal responsibility for the near-collapse of state shipping giant Vinashin.

    While the moves against Kien are not expected to force Dung from his post, more of the prime minister's allies are likely to be targeted, observers predict.

    Kien "may be the most prominent and wealthy" thus far, but he was not the first nor will he be the last, said Thayer, emeritus professor at the University of New South Wales in Australia.

    Dung himself, in what experts see as an effort at self-protection, has praised the police efforts to investigate corruption in bank reform and called for punishment of culprits "no matter who they are".

    IRVINE, CA ? August 24, 2012 ? (Motor Sports Newswire) ? Last August saw the Motorcycle Safety Foundation launch the unprecedented, one-year-long MSF 100 Motorcyclists Naturalistic Study in conjunction with Virginia Tech Transportation Institute. It was designed to track comprehensive, real-time routine riding that likely included near crash, pre-crash, and actual crash data that had heretofore been unavailable. The study is yielding preliminary results that will be released at a later date.

    ?This field research provides the opportunity to observe motorcyclists in their natural day-to-day experiences,? said Dr. Sherry Williams, MSF director of quality assurance and research. ?We were interested in what riders do on a natural basis ? their normal, routine riding behavior. Basically, a naturalistic study is where you rig a camera or data recording device to someone?s personal motorcycle in an unobtrusive fashion so they soon become unaware they?re being recorded. It differs from traditional research, where a rider is put into a specific, laboratory-type scenario or has to crash first and then recall details after the fact.?

    Sponsored by MSF and administered by VTTI, the MSF 100 Motorcyclists Naturalistic Study is the first of its kind in the motorcycling world. Similar to NHTSA and VTTI?s 100-Car Naturalistic Study, an automotive naturalistic study, this groundbreaking research is tracking 100 participant-owned motorcycles for one year and approximately 500,000 total miles.

    Each motorcycle was equipped with extensive data acquisition systems, which include five color cameras, a GPS, accelerometers, gyroscope, forward radar, machine vision lane tracker, brake lever and pedal input sensors, and more.

    ?This research is very different from anything we?ve done before,? said Dr. Williams. ?It offers much more valuable data than going to a crash site where the motorcycle may have been moved or removed and investigators are left to reconstruct the scene and infer primary crash factors. These locations were selected because they offer a variety of riding conditions and traffic densities.

    ?We are very excited about this pioneering research,? said MSF President Tim Buche. ?While we applaud the research that has been done in the past, we must acknowledge that, to date, we simply have had no data on how riders perform in everyday, uneventful riding. In the U.S. each year, riders travel over 25 billion miles, they ride safely and without incident. Riders have not been scientifically observed in a natural setting.     VTTI recruited 100 volunteer participants, who participated anonymously, based primarily on their age and model of motorcycle owned.     Two dead, 9 wounded in gunfire near NY's Empire State Building

    NEW YORK (Reuters) - An out-of-work fashion designer fatally shot a former co-worker near the Empire State Building on Friday and was then killed in a blaze of gunshots by police, stunning tourists and commuters outside of one of New York's most popular landmarks.

    Nine bystanders were wounded, possibly all of them by police bullets, though none of their injuries were life-threatening, police said. Much of the day, police listed the casualty total at 10 people but late Friday changed the number to 11.

    Officials said women's accessories designer Jeffrey Johnson, 58, had been laid off from Hazan Imports a year ago and that while working there, had been locked in a dispute with the victim. Police said Johnson had claimed the victim failed to sell enough of his creations and held a grudge.

    Investigators were attempting to determine whether Johnson shot anyone beyond his initial target. All nine of the surviving victims could have been hit by the two police officers who shot at Johnson, officials said.

    Several were likely hit by police bullets that ricocheted off large, anti-terror concrete flower pots stationed outside the Manhattan landmark, police said.

    Other than its proximity, the Empire State Building had no link to the violence. Mayor Michael Bloomberg ruled out any connection to terrorism.

    The shooting rattled an always-busy part of Midtown Manhattan at the height of the tourist season.

    "I saw a friend of mine lying on the street bleeding. She was in shock," said Christopher Collins, who said he tried to keep her calm as he rode with her in an ambulance. "I'm glad the cops shot him dead. One less trial we have to go through."

    The mother of a co-worker who witnessed the shooting identified the dead executive as Steve Ercolino. Police declined to confirm his identity.

    Ercolino was walking toward Hazan Imports, across 33rd Street from the Empire State Building, and stopped to talk to a colleague. Johnson, dressed in a suit and tie and carrying a black canvas bag, walked up and shot Ercolino at close range, police said, and then stood over the man and shot him again - a total of five shots.

    HISTORY OF ANIMOSITY

    Johnson, carrying a second magazine in his bag, then walked "calmly" a block away, police said, past two officers stationed in front of the entrance to the Empire State Building.

    A pair of construction workers who witnessed the shooting followed Johnson and tipped off the officers, pointing at Johnson as he passed, police said.

    The two cops approached Johnson, who drew his gun, turned and pointed it directly at the officers from about eight feet away, police said. Police opened fire and shot him, Police Department spokesman Paul Browne told reporters.

    One officer fired nine times and the other seven times, Browne said. Investigators believe Johnson was shot seven times; his body had 10 bullets wounds, three of which were believed to be exit wounds, Browne said.

    Animosity between Johnson and Ercolino had prompted them to file counter complaints with police in April 2011, Browne said. No charges resulted from the complaints.

    It was the third major shooting of the summer in the United States, following an assault on a crowded cinema in Colorado and an attack on a Sikh temple in Wisconsin, rekindling debate about gun control in America. The New York shooting was different in that Johnson appeared to have only one intended victim.

    In the July 20 Aurora, Colorado shooting, a gunman opened fire at a midnight screening of the Batman film "The Dark Knight Rises," killing 12 people and wounding 58.

    "We are not immune to the national problem of gun violence," said Bloomberg, a leading national proponent of gun control and founder of the group Mayors Against Illegal Guns.

    Bloomberg has often called New York the safest big city in America, citing a declining crime rate that had the city on pace for another record low number of homicides in 2012.

    "It's time to get the guns off the street," said Brandon Thorpe, 23, a janitor who said he has lost five friends to gun violence. "This is a tourist attraction. How are we supposed to make people feel safe if they come here and see something like this?"

    The Empire State Building is walking distance from Pennsylvania Station and Grand Central Terminal, two of New York's main transportation hubs, and the shooting took place at the end of the morning rush hour.

    "I heard the gunshots. It was like pop, pop, pop. It was definitely in a bunch," said Dahlia Anister, 33, who works at an office near the building.

    BLOODY SIDEWALK

    Mail courier James Bolden, 31, said he saw a "guy laying on the (sidewalk), bleeding from the neck and barely breathing."

    "Everybody was crowded around him taking pictures and video, and security guys were yelling everybody to get back, and give him space. He was barely breathing," Bolden said.

    One witness said she saw a woman who was shot in the foot and another woman being taken away in an ambulance.

    "I was walking down 33rd (Street) and there's a dead guy. I just saw pools of blood. He was laying down and there was blood pooling (around him)," said Justin Kellis, 35, who works nearby.

    On August 5, a gunman killed six people and critically wounded three at a Sikh temple outside Milwaukee before police shot him dead in what authorities viewed as an act of domestic terrorism.

    This was the second high-profile shooting incident in two weeks in New York's tourist-heavy Midtown Manhattan. On August 12, New York police shot and killed a knife-wielding suspect as he sought to evade them through Saturday-afternoon traffic and pedestrians in Times Square.

    The art deco Empire State Building was the world's tallest building for 40 years from its completion in 1931 until construction of the World Trade Center in 1971.

    Several skyscrapers around the world have since surpassed the New York buildings. Following the September 11, 2001, attacks that destroyed the World Trade Center, the Empire State Building was again the tallest building in New York City, though it was recently surpassed by a new tower under construction at Trade Center's site.

    Medical researchers identify PHF20, a regulator of gene P53

    ScienceDaily (Aug. 24, 2012) ? Researchers at Moffitt Cancer Center and colleagues have identified PHF20, a novel transcriptional factor, and clarified its role in maintaining the stability and transcription of p53, a gene that allows for both normal cell growth and tumor suppression. PHF20, the researchers found, plays a previously unknown and unique role in regulating p53.

    When p53 is activated, it can mend DNA damage and eliminate cancer cells by binding to DNA. How p53 maintains its basal level and becomes activated remain elusive, but identifying transcription factor PHF20 and understanding its interaction with p53 and its induction of p53 protein stability and transcription has provided a clue.

    Results of their research appeared in a recent issue of Nature Structural & Molecular Biology and also in The Journal of Biological Chemistry.

    "When a cell undergoes alterations that predispose it to become cancerous, p53 is activated to either mend the DNA damage or eliminate the affected cells, thereby preventing the development of tumors," said Jin Q. Cheng, Ph.D., M.D., a senior member of the Molecular Oncology Department and Molecular Oncology and Drug Discovery Program at Moffitt. "A number of mechanisms normally keep a regulatory strong check on p53 and allow for rapid activation. Still much is unknown about the mechanism of p53 regulation."

    After identifying PHF20 as a novel transcriptional factor, the researchers set out in subsequent studies to probe the function of human PHF20 and its effect on p53. They found that PHF20 not only transcriptionally induces p53 but also directly interacts with and stabilizes p53. Akt negatively regulates these processes by interaction and phosphorylation of PHF20.

    To determine whether the absence of PHF20 might regulate stress-induced p53 expression, the researchers "knocked down" PHF20. In doing so, they demonstrated that in the absence of PHF20, p53 was reduced. These findings established the role of PHF20 as a key regulator of p53 and additional link between Akt and p53.

    According to Cheng, the identification of PHF20 as a regulator of p53 is significant because PHF20 "participates in simultaneous multiple interactions with other proteins and DNA" and serves to stabilize and induce p53.

    "Regulation of p53 is critical to allow both normal cell growth and tumor suppression," explained Cheng. "However, further investigation is required to understand PHF20 tumor suppressor function and its possible involvement in human malignancy."

    Cities turn to innovative 'green infrastructure'

    From Seattle to Sweden, city and regional governments are using roof gardens, specially designed wetlands, and other forms of 'green infrastructure' to rein in pollution ? and to save money.

    When it rains, storm water washes into the same system of underground pipes that carries the region?s sewage, and 1 billion gallons a year overflow into the sound when area sewer systems contain more water than can be treated. In addition, motor oil, lawn chemicals, PCBs, heavy metals, pet waste, and many other substances run unabated into the sound, both through the storm water pipes and from roads and other shoreline structures. ?The biggest threat to Puget Sound is non-point sources [of pollution],? says Nancy Ahern, Seattle Public Utilities deputy director.

    Blowhole samples taken from killer whales have revealed fungi, viruses, and bacteria living in their respiratory tracts, some of them antibiotic-resistant and once found only on land. Health officials often have to shut down oyster beds because of fecal contamination. Salmon in streams are killed by torrents of dirty storm water.

    To lessen this deluge of diffuse pollution ? a problem faced by many regions worldwide ? Seattle is looking not at new and expensive sewage treatment infrastructure. Instead it is embracing an innovative solution to storm water runoff called green infrastructure, which experts increasingly say is not only the most cost-effective way to deal with such a large-scale problem, but also offers a range of other benefits. A growing number of places, from New York City to Sweden, are investing in everything from rooftop gardens to pollution-filtering assemblages of trees to reduce tainted runoff.

    Gray infrastructure is the system of pipes and ditches that channel storm water. Green infrastructure is the harnessing of the natural processes of trees and other vegetation ? so-called ecosystem services ? to carry out the functions of the built systems. Green infrastructure often intercepts the water before it can run into streets and become polluted and stores the water for gradual release through percolation or evapotranspiration. Trees also clean dirty water through natural filtering functions.

    Advocates say green infrastructure isn?t just about being green ? it makes financial sense, as well. Its cost-effectiveness depends on how benefits are assigned and valued, and over how long a time scale, but green has been shown to be cheaper than gray.

    A 2012 study by American Rivers, ECONorthwest, and other groups examined 479 projects around the country. About a quarter of the projects were more expensive, they concluded, and 31 percent cost the same; more than 44 percent brought the costs down, in some cases substantially. New York City, for example, expects to save $1.5 billion over the next 20 years by using green infrastructure.
