Without Ben Nelson, can Democrats keep control of Senate in 2012?

The decision by Sen. Ben Nelson (D) of Nebraska not to run for reelection in 2012 is a 'blow' to Democrats' efforts to retain their Senate majority, analysts say.?

With the retirement of Sen. Ben Nelson (D) of Nebraska, announced Tuesday, Democrats have yet another open seat to defend in a 2012 election year that could flip control of the Senate to Republicans.

Democrats are defending 23 seats in the 2012 campaign cycle, compared with 10 for Republicans. With Democrats holding a 53-to-47 majority, Republicans need to pick up four seats to wrest control from them. If President Obama fails to win a second term, that threshold falls to three seats, because the vice president breaks tie votes.

?Given that the [Senate] majority is at stake, it?s a blow,? says Jennifer Duffy, senior editor of the Cook Political Report in Washington, of Senator Nelson's decision not to seek reelection next year.

?Nelson was going to face a very tough race, but you couldn?t write him off,? she adds. ?He?s won difficult races before. There?s not an obvious candidate of his stature with the ability to raise money to replace him."

The two-term Nebraskan has been the Senate?s most reliable centrist, at a time when the ranks of moderates in Congress have been diminished almost to the point of extinction.

?Simply put: It is time to move on,? Nelson said in a video statement to Nebraskans on his Senate website.??I encourage those who will follow in my footsteps to look for common ground and to work together in bipartisan ways to do what?s best for the country, not just one political party.?

Often the lone Democrat voting with Republicans, Nelson broke party ranks to vote to extend the Bush-era tax cuts and to oppose legislation that gave some children of illegal immigrants a path to US citizenship. He joined with the so-called gang of 14 to work out a compromise over stalled judicial nominations, averting what was known at the time as the ?nuclear option? to ban filibusters on judges. He?s also the lone Democrat in Nebraska?s congressional delegation.

Without Nelson?s support, Democrats could not have passed Mr. Obama?s health-care reform in 2010 ? one of the president's campaign pledges. Nelson in the end gave Democrats the 60th vote they needed to block a GOP filibuster.

Apple's first touchscreen phone prototype dates back to 1983

Curious how the iPhone would have looked like in 1983? Apple turns out to have indeed been working on a touchscreen device back then as an early prototype dating back to nearly 30 years ago was found. Designer Hartmut Esslinger stood behind the design, but it seems he was ahead of his time.

Esslinger was then hired with a million dollar contract and tasked to craft a unique design strategy to bring Apple from just another Silicon Valley start-up into the global brand that it is today.?

He later created the "Snow White design language" the company is famous for even today, but back then it was implemented on the Apple II and the Macintosh computer.

Sure, the prototype you?re seeing on the picture is a landline rather than a mobile phone, but nonetheless it?s revealing that such a technology was imagined back then. Sadly, except for the picture we have no more details about what features would the device have. Interestingly it also comes with a stylus, something Steve Jobs condemned in the iPhone and future iOS devices.

'Hunger Games' Suspense Kicked Into High Gear In 2011

The film might not hit theaters until next year, but casting announcements and exclusive interviews got fans worked up for March release.

For the millions of fans who have been eagerly awaiting a film adaptation of Suzanne Collins' best-seller "The Hunger Games," 2011 gave them even more to be eager about as details trickled out about the movie, which is due in March.

We at MTV News have been as caught up in the frenzy as everyone else. And along the way, we've been able to speak with the major players involved in the "Games," gleaning the juiciest details from the likes of Jennifer Lawrence, Liam Hemsworth and Josh Hutcherson.

Back in January, before casting was solidified, Hemsworth told MTV News he'd read the script and that he could actually see himself in the role of Peeta. After Hemsworth won the role of Gale instead, we chatted up his older brother and fellow actor Chris Hemsworth, who revealed that he helped Liam prep for his big audition by reading the role of Katniss. "I did. Swear to God," he said. "I read that. Put my girly American accent on."

In May, we had our first "Hunger Games"-centric chat with Jennifer Lawrence. She discussed fans' initial protests over her blond hair, which quieted after she dyed it, along with the intense hours of archery training she went through to become as convincingly handy with a bow and arrow as Katniss is.

"It's lots of training, but the training is actually really fun," she said. "I've done archery for about six weeks, rock climbing, tree climbing and combat and running and vaulting," she said. "Also yoga and things like that to stay cat-like."

We also caught up with some of the film's supporting actors. Lenny Kravitz, who is ready to further prove his acting chops in the role of sympathetic District 12 stylist Cinna, said he's doing his homework by immersing himself in all Collins' books. Elizabeth Banks was a bit more cagey in revealing any details about her transformation into pink-haired, type-A Effie Trinket, but she did admit that she and co-star Woody Harrelson have chemistry.

Harrelson, who plays alcoholic Hunger Games survivor Haymitch Abernathy, praised Lawrence's portrayal of Katniss and revealed that his character's hairstyle was inspired by his own brother. "I was like, 'OK, let's get a wig. Let's do the Brett Harrelson hair,' " he said of the long and slightly shaggy style. "It's kind of cool. I really liked the look. It's a fun character, and I think it's going to be a good movie."

Fellow supporting player Stanley Tucci, a.k.a. the blue-haired Caesar Flickerman, echoed Harrelson's sentiments about Lawrence's performance. "She was amazing," he said. "They were all amazing. She's just so good and so mature at such a young age. It was really fun. Really fun. And [director] Gary Ross, he's great."

We didn't have to take Tucci's word for it, as we also sat down with Ross for an exclusive interview surrounding our debut of the "Games" teaser trailer back in August. The "Seabiscuit" and "Pleasantville" helmer took us through his detailed plans for the film and the challenges of filming.

And we finally stole a few moments with Peeta Mellark himself, Josh Hutcherson. who took us through his grueling audition process and the anxious wait for the news of his casting, why he was "so right" for Peeta and his excitement for the fans to see the finished product.

"It's exciting to hear people are that interested in something you're doing, so it's a little nerve-racking, but I'm onboard," he said. "The fans for 'The Hunger Games,' they're die-hard. They're the best fans in the world, so I'm really excited for them to see the movie."

3 miners rescued from Tenn. mine after fire

Tennessee on Wednesday, trapping three miners inside for about three hours before they were rescued, authorities said. Two other miners below ground were injured by smoke inhalation.

The three miners were trapped by smoke and needed respirators before they could leave the mine. A rescue team helped the miners and they appeared unharmed, though they are being taken to a hospital, said Tim Wilder of the Jefferson County EMA.

The two injured miners were taken to a local hospital had minor smoke inhalation, New Market Fire Department Captain Sammy Solomon said

There were 54 miners underground when the fire started on a drill rig about 800 feet below the ground, officials said.

The three men were able to make it to a safe room about a mile underground. About an hour after the fire ignited around 1:10 p.m. EST, they were able to make contact with people on the surface of the mine, officials said.

It was not clear yet how the fire started at the Young Mine about 25 miles northeast of Knoxville. The mine is operated by the Switzerland based company Nyrstar.

A spokeswoman for Nyrstar said the miners were in "fine spirits" after they were rescued.

REPORT: The Next iPhone Will Have A Brand ... - Business Insider

Apple is getting ready to launch a completely redesigned iPhone for a Fall 2012 release, according to BGR, citing a close source.

The new phone will feature a rubbery material on the back that will connect the phone's aluminum backing to the front bezel.

Think of it as a built in "bumper" like the ones Apple sells now for the iPhone 4 and 4S.

BGR's source did not mention whether or not the next iPhone will have a larger, 4-inch screen, as many have reported before.

As with any rumor, don't take this as fact. Fall 2012 is a long way out and things could easily change.

Islamic Honor Killing In Texas: "Santa Killer" Was Muslim Who Hated Daughter Dating A Non-Muslim

The mainstream media has reported this as the "Santa killer." No mention that it was an Islamic honor killing until this Dallas Morning News story. Our daughters and granddaughters are going to be the ones who will suffer because of for this obfuscation and excusal of barbarism.

This has been going on for years. When Amina and Sarah Said were brutally murdered by their father, also in Texas, on New Year?s Day 2008 for the same reason -- having non-Muslim boyfriends -- I thought, this is it. This is going to break the dam wide open. America would not, could not possibly, ignore this horror caused by and sanctioned by Islamic beliefs, assumptions, and attitudes.

And yet America continues to ignore this horror. And more and more people are victimized every day.

Aziz Yazdanpanah, a Muslim, didn't like his daughter's non-Muslim boyfriend and was exhibiting stalker behavior. ?She couldn?t date at all until she was a certain age, but when he was going to let her date she couldn?t date anyone outside of their race or religion.?

Again and again we have seen honor killings in which fathers kill daughters who are dating non-Muslims or have supposedly besmirched the family honor by some sexual indiscretion. Lt. Todd Dearing says that motive isn't important -- which is generally only the case when Islam is involved.

GRAPEVINE ? Aziz Yazdanpanah seemed to be losing control of his life in recent months ? his wife left him, his house was in foreclosure, and his 19-year-old daughter was dating a young man he didn?t like.

Even so, the 58-year-old former real estate agent from Colleyville seemed to be holding it together. Neighbors say he would smile and wave as he drove through his middle-class neighborhood. Recently, he was seen raking leaves in his yard.

?He was very friendly, a very good neighbor,? said Carrie Stewart, who lives across the street. ?He was out here often doing yard work and he even watched our house for us when we went to Colorado.?

A decent fellow indeed.

Yazdanpanah, a volunteer high school debate coach described as a doting father, is the focus of suspicion a day after a Christmas morning massacre in which a man dressed as Santa Claus killed six relatives and then committed suicide.

Grapevine police arrived at the Lincoln Vineyard Apartment Homes a few minutes before noon and discovered bodies sprawled among opened presents and wrapping paper. The victims were ages 15 to 58....

Citing public records and interviews with friends and neighbors, media reports Monday identified Yazdanpanah and others who had died: his estranged 55-year-old wife, Fatemeh Rahmati, their 19-year-old daughter, Nona Narges Yazdanpanah, and 15-year-old son, Ali Yazdanpanah.

Friends of the family said Fatemeh Rahmati?s 58-year-old sister, Zohreh Rahmaty, and her husband, Hossein Zarei, 59, and daughter Sahra Zarei, a 22-year-old pre-med student at the University of Texas at Arlington, also were killed.

Grapevine police Lt. Todd Dearing said investigators were working to piece together a timeline of the murders, but they may never know exactly what set off the gunman.

?Motive is not really the primary point right now,? Dearing said. ?It?s more along the lines of what happened, how it transpired and making sure that who we believe to be the shooter is the shooter. Motive is what comes afterward for us if we can get it.?

He said a neighbor at the apartment complex saw the suspected shooter get out of his white sport utility vehicle dressed in a Santa outfit, including a full coat, pants, boots and belt. Based in part on that witness account, police believe the shootings occurred about the time a 911 call rang into the station at 11:34 a.m. Sunday.

Grapevine police also searched the Colleyville home where Aziz Yazdanpanah had been living since he separated from his wife last spring. Public records show that the couple had filed for bankruptcy in 2010 and that the property was in foreclosure....

Yazdanpanah said he bought a gun after expressing concern that his daughter?s boyfriend was stalking him. He also insisted on picking up his daughter from her job at a phone kiosk inside Sam?s Club in Grapevine because of concerns about the alleged stalker.

The boyfriend has not been publicly identified.

Neighbors said the family was Muslim but had always hung Christmas lights on their home ? except this year.

Terri Baum, who lives three homes down from Yazdanpanah, said she had seen him around the neighborhood in the last couple of weeks.

?They were pretty quiet, but kind, very kind,? Baum said. ?They were sweet, good parents, and they loved their kids very much.?

Baum?s daughter, Allison, attended Colleyville Heritage High School with Nona, where the girls were part of an academic team focused on developing business leaders. They graduated together in May.

?Allison would take her to school from here, and then when they moved out she would pick her up from the apartments,? Baum said. ?It?s unbelievable because of the people we knew them to be, and their children were good kids, very focused.?

Baum said she was horrified at the possibility the killings had been a murder-suicide.

?All I want to say is, it is so unbelievably shocking because they loved their kids,? Baum said.

Yes, loved them to death.

But a more ominous portrait emerged of Yazdanpanah in interviews with some of his daughter?s other classmates.

?She would come to school crying and telling us her dad was crazy,? said Lacie Reed, 18. ?He wouldn?t let her wear certain things. He was always taking her phone away, checking her call history and checking her text messages.?

Friends said Nona?s father had installed cameras all around the home so he could watch the family?s comings and goings. Others said he nailed her bedroom window shut so she could not sneak out at night and see her boyfriend.

?She couldn?t date at all until she was a certain age, but when he was going to let her date she couldn?t date anyone outside of their race or religion,? Reed said.

Yiselle Alvarenga, 18, said Nona?s mother and brother seemed to come to her aid when her father punished her.

?He would take her phone away and her mother would give it back to her and her brother would let her use his phone,? Alvarenga said. ?She was doing good. She was just excited that her life was going to start and she was going to have control of it.?...

LA man charged with $7M fraud of divorcee (omg!)

SACRAMENTO, California (AP) ? A self-described Los Angeles entertainment entrepreneur was charged in a federal indictment unsealed Tuesday with bilking $7 million from a recent divorcee who is identified by law enforcement officials as the ex-wife of actor-comedian Eddie Murphy.

Troy David Stratos faces 14 charges of fraud, money laundering and obstructing justice. Stratos, 45, was arrested Tuesday and made his first appearance in Los Angeles federal court. His attorney, Walter Urban, did not return a telephone message.

The divorcee is identified in court papers as "N.M...the ex-wife of E.M." who filed for divorce in August 2005. Three law enforcement sources told The Associated Press that the victim is Eddie Murphy's ex-wife, Nicole Murphy, but the officials spoke on condition of anonymity because they were not authorized to release the identity of the alleged victim in the case.

Court officials would not confirm that the alleged victim is the actor-comedian's ex-wife.

Court records show Nicole Murphy sued Stratos and others last year in Los Angeles federal court and refiled the lawsuit in May in Florida state court. She filed for divorce from Eddie Murphy in August 2005.

The indictment charges that Stratos persuaded his victim to invest the proceeds of her divorce overseas, promising that she would earn a high rate of return. She put the proceeds into a revocable trust with Stratos in Fair Oaks, a Sacramento suburb, according to the federal indictment.

Prosecutors say Stratos never invested the money, but spent it on himself. He also opened a bank account in Florida, they say, and used portions of the money to pay the victim's expenses while leading her to believe he was paying her expenses out of his own pocket.

Nicole Murphy's federal lawsuit alleges she put $11 million into a trust with Stratos but he and the other defendants spent the money on themselves.

The wire and mail fraud charges carry a maximum penalty of 20 years in prison, while the money laundering and obstruction charges carry 10-year maximum sentences.

Stratos claimed to be involved in the entertainment industry as a movie and video producer and director, as well as a talent promoter, prosecutors said.

Attorneys representing Nicole Murphy in her federal lawsuit declined comment. She divorced Eddie Murphy after a 12-year marriage. They had four daughters and one son.

She previously owned a home in the wealthy Sacramento suburb of Granite Bay, though her federal lawsuit says she now lives in Calabasas outside Los Angeles.

Stratos told her he could sell her home to members of Middle Eastern royal families, but said she should lease luxury Rolls-Royce and BMW automobiles to make the property more attractive. The vehicles would then be sold as a package deal with the home, the indictment said.

But Stratos lived in the home and used the leased vehicles, never arranging for them to be sold, according to the charges. He later persuaded the woman to refinance several of her homes, including homes in Granite Bay and Sacramento, to get more cash, the charges allege.

Thom Mrozek, a spokesman for the U.S. attorney in Los Angeles, said Stratos has agreed to be returned to Sacramento to face the charges, and he is jailed pending a bail hearing scheduled for Wednesday.

Orion continues to make a splash

ScienceDaily (Dec. 5, 2011) ? Testing continues at NASA Langley Research Center as the 18,000-pound (8,164.6 kg) Orion test article took its seventh splash into the Hydro Impact Basin Dec. 1.

Orion, NASA's next deep space exploration vehicle, will carry astronauts into space, provide emergency abort capability, sustain the crew during space travel, and ensure safe re-entry and landing.

The testing, which began in this summer, simulates different water landing scenarios and takes into account different velocities, parachute deployments, entry angles, wave heights and wind conditions that Orion may face when landing in the Pacific Ocean.

"We are doing several of these tests to look at the operational envelope for the Orion landing conditions and the analysts need as much data as we can possibly give them," said Lynn Bowman, SPLASH project manager. "In order to do it in as few cases possible, we have to look at these critical cases, which is not your average landing scenario or sea condition."

The Dec. 1 test was all about the heat shield and how much it would flex after hitting the water at a slightly different angle. Sea conditions simulated a low-wind swell case.

The test article was only two feet above the water before it dropped pancake-style into the water. It traveled about 7 mph (11.26 kph).

There are more than 150 sensors on the test article that record data during each test drop. The results of these initial tests will help improve the design for the actual flight vehicle.

The last drop of the year is tentatively scheduled for Tuesday, Dec. 13.
